Welcome to Kaleidoscope Penguin Collective (“KPC,” “we,” “us,” or “our”). These Terms of Use apply to your use of the KPC website and other KPC-operated online content.

KPC is a community-oriented creative space for events, workshops, education, arts, entrepreneurship, connection, and other activities. We want our corner of the internet to work much like our physical space: explore, connect, create, and please don't knock over the furniture.

By using our website, you agree to these Terms of Use.

1. Website Content

The information on this website is provided for general informational, educational, promotional, and community purposes.

We work to keep information accurate and current, but event details, availability, pricing, programs, instructors, partners, policies, and other information may change.

Nothing on this website constitutes legal, financial, medical, tax, or other professional advice.

2. Events

KPC hosts, sponsors, collaborates on, and provides space for a variety of events.

Some events are produced directly by KPC. Others may be presented, facilitated, sponsored, or organized by independent individuals or organizations.

Event descriptions should identify the applicable presenter or organizer when appropriate.

Participation in particular events may be subject to additional terms, waivers, eligibility requirements, community expectations, refund policies, or other conditions disclosed during registration or before participation.

3. Event Registration and Humanitix

KPC generally uses Humanitix for event registration and ticketing.

When you register for or purchase admission to an event through Humanitix, your use of the Humanitix platform is subject to Humanitix's applicable terms, privacy notice, refund requirements, and other policies.

KPC may establish event-specific cancellation, refund, transfer, attendance, or participation policies where permitted by the applicable ticketing platform and law. Those policies will generally be provided with the applicable event listing.

4. Space Rentals

Information on this website regarding renting or using the KPC space is informational and does not itself create a reservation, lease, license, or other right to use the space.

Space use is confirmed only through the applicable booking or rental process and may require acceptance of a separate rental agreement, payment, deposit, insurance requirements, or other conditions.

Availability is not guaranteed until a booking is confirmed.

5. Community Expectations

KPC is intended to be a welcoming community space.

When participating in KPC events, activities, online spaces, or other KPC-sponsored experiences, we expect people to treat others with respect and to comply with applicable KPC community guidelines, event rules, safety requirements, and law.

KPC may take reasonable action to protect its community, participants, staff, property, and operations, including limiting participation or access when appropriate and permitted by law.

6. Intellectual Property

Unless otherwise stated, KPC owns or has permission to use the text, graphics, branding, photographs, designs, logos, and other content created by or for KPC and displayed on this website.

You may view and share links to publicly available KPC webpages for personal and informational purposes.

You may not reproduce, sell, commercially exploit, materially modify, or represent KPC content or branding as your own without permission, except where permitted by law.

Content created or presented by artists, instructors, performers, partners, renters, speakers, or other third parties remains subject to the rights of its respective owner.

7. User Submissions

If you submit an event idea, partnership proposal, inquiry, feedback, photograph, testimonial, or other material to KPC, you represent that you have the right to provide that material.

Submitting an idea or proposal does not require KPC to accept, produce, compensate, or pursue it unless we separately agree otherwise.

Please do not send confidential, proprietary, or sensitive information unless requested or an appropriate agreement is in place.

8. Third-Party Services and Links

KPC uses and links to third-party services, including Squarespace, Humanitix, Google services, Instagram, Facebook, and LinkedIn.

These services are operated independently and have their own terms, privacy policies, accessibility practices, and other rules.

KPC does not control and is not responsible for the availability, security, content, privacy practices, accessibility, or operation of third-party services.

9. Social Media

KPC maintains social-media accounts to communicate with our community and share information about events and activities.

Your use of Instagram, Facebook, LinkedIn, or another social-media service is governed by that platform's own terms and policies.

Comments, posts, messages, tags, or other interactions made through those services may also be subject to the platform's moderation and content rules.

10. No Guarantee of Availability

We may modify, suspend, remove, or discontinue website content, events, programs, or features at any time.

We do not guarantee that the website or any third-party service will always be available, uninterrupted, error-free, or free from harmful components.

11. Third-Party Events and Content

KPC may promote, host, or link to events, businesses, organizations, instructors, artists, or resources operated by others.

Unless specifically stated otherwise, inclusion on the KPC website does not mean that KPC controls or assumes responsibility for the third party's products, services, statements, conduct, or activities.
